Claro Labs, a Colorado based company, is a Toxicology testing service which provides a variety of products and services to its customers (“Products and Services”). Use of the Products and Services is governed by this Terms and Conditions of Use Policy, together with any documents expressly incorporated by reference (collectively, this “Agreement”). Throughout this Agreement, Claro Labs may be referred to as “we” or “us” and in the possessive, “our”, and you the customer may be referred to as the “user”, “you” or, in the possessive, “your”.

Some Samples may not be able to be processed, and the laboratory testing process may result in errors. ClaroLabs is a CLIA certified and College of American Pathologists (CAP) accredited testing laboratory that has standard and effective procedures in place to protect against testing errors. However, analytical errors may still occur. Resulting problems may include but are not limited to procedures of sample collection by clients, shipping to the laboratory, mislabeling of specimens, analysis of results, or sending reports. Laboratory problems can occur that might lead to inability to obtain results. If signs of a laboratory error are observed, consultations from a health care professional should be obtained and/or evaluated for further testing. Even for processing that meets our high standards, a small, unknown fraction of the data generated during the laboratory testing process may be un-interpretable or incorrect (referred to as “Errors”). As this possibility is known in advance, users are not entitled to refunds where these Errors occur.
Testing for genetic variation/mutation on listed genes is performed using PCR with allele-specific probes. Test results do not rule out the possibility that an individual could be a carrier of other variations not detected by this gene variation panel. Rare mutations surrounding these alleles may also affect our detection of genetic variations. Other non-genetic and genetic factors that are not tested by this assay can affect the management and sensitivity of drugs. Thus, the interpretation is given as a probability. Therefore, this genetic information should be interpreted in conjunction with other clinical findings and familial history of diseases.
Genetic information you disclose with others could be used against your interests. You should be careful about disclosing your genetic information with others. While the Genetic Information Nondiscrimination Act (GINA) was signed into law in the United States in 2008, its protection against discrimination by employers and health insurance companies for employment and coverage issues has not been clearly established. Any dispute relating in any way to your visit to ClaroLabs or to the Products and Services you purchase through ClaroLabs shall be submitted to confidential arbitration in Lafayette, Colorado. Arbitration under this Agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
Governing Law and Jurisdiction
All matters relating to the Website and this Agreement and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Washington without giving effect to any choice or conflict of law provision or rule (whether of the State of Colorado or any other jurisdiction).
Any legal suit, action or proceeding arising out of, or related to, this Agreement or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Colorado, in each case located in the City of Lafayette, although we retain the right to bring any suit, action or proceeding against you for breach of this Agreement in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Limitation on Time to File Claims
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THIS AGREEMENT OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
Waiver and Sever-ability
No waiver by ClaroLabs of any term or condition set forth in this Agreement shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of ClaroLabs to assert a right or provision under this Agreement shall not constitute a waiver of such right or provision.
If any provision of this Agreement is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of this Agreement will continue in full force and effect.
The section titles in this Agreement are for convenience only and have no legal or contractual effect.

Simply follow the instructions prompted on our Website. Once you have placed your order, we will send you a confirmation e-mail providing you with a reference number and the total value of your order that will be debited from your credit/debit card.
Claro Labs accepts payments through the following methods: Credit/Debit Card/Paypal. Claro Labs accepts Visa, MasterCard, American Express, and Discover.
By providing us with details of the payment card and submitting the order, you confirm that the credit/debit card that is being used is yours, and you authorize us to deduct the full price of the Products and Services and all other payments that may become due at the time of checkout under this Agreement from your payment card.
All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses, for any reason, to authorize payment to us, we are not liable for any delay or non-delivery of Products and Services.
Delivery costs for your order will be clearly set out before you place your order.
Delivery of your order will be made to the address for delivery you provide on the order form. It is important that this address is accurate. You acknowledge and accept that Claro Labs will not be held responsible for the delivery of your order to an incorrect address in instances where delivery to such address is due to the address being incorrectly stated on the order form.
Claro Labs aims to ship your test kit by ordinary mail within two business days of receipt of order.
Delivery timescales are indicative only. Claro Labs does not accept any liability whatsoever for delayed delivery caused by any third party or by circumstances out of its control, including but not limited to local, national or international disruption of postal services. You acknowledge that you may be required to sign for your order on delivery, and it is your responsibility to ensure that you are available to sign for the order on delivery.
Our prices do not include local taxes and tariffs. Customers outside of the US may be subject to customs fees and/or import duties and taxes, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; you should contact your local customs office or tax authority for information specific to your situation. Additionally, when ordering from Claro Labs you are considered the Importer of Record and you acknowledge and confirm that you will:
(i) comply with all laws and regulations of the country in which you are receiving the Product;
(ii) complete and file any duty entry form or any other document as is required; and
(iii) pay all import duties and other taxes as may fall due on the Products.
Cancellation. Every effort will be made to accommodate the cancellation of your order, providing your orders have not been shipped out. In the event that a cancellation was submitted and your order was shipped out after, we will gladly refund the complete balance charged including shipping. However, if the cancellation was documented as received after your order was shipped, we will refund you the test price less 15% of the purchase price to cover the cost of the kit and shipping/postage.
To cancel your contract, you must notify us by email at email@example.com.
If you cancel your contract with Claro Labs for the Products, you must return the Products to Claro Labs. If you have received the Products before you cancel your contract, the Products should be returned to us with the original packaging to:

You will be responsible for the cost of returning all unwanted (non faulty) Products to us. The Products are your responsibility until they reach us. Therefore for your own protection we recommend that you send the parcel using a recorded delivery service that insures you for the value of the goods.
We will give you a refund for the full price paid for all unwanted (non faulty) Products on receipt, including the cost of postage and packaging charges for the original delivery, but excluding the return costs.
Damaged or Faulty Goods. The liability of ClaroLabs and the user’s remedy for any defective Product(s) supplied under these Terms shall be a replacement or refund by Claro Labs of the defective Product(s).
If you find that your Product(s) arrive in an unsatisfactory condition please contact us via e-mail at firstname.lastname@example.org within 48 hours of when you received the Products, with the following information: First name, last name, order number, and email address. This information must be identical to the information originally submitted on your order. Please provide contact information so that we may contact you if we have questions in regards to cancelling your order.
We will request you to return the faulty Products to us by recorded delivery and the Products will then be inspected by us. If the fault is agreed, we will either:
(i) give you a refund for the full price paid for the Products, including the original delivery charges and the cost of returning the Product to us; or
(ii) send a new Product of the same type to you.
The decision as to whether we provide a refund or send a new Product to you will be entirely at our discretion.
Refunds. Refunds will be made using the same method originally used by you to pay for your purchase. We will process the refund due to you as soon as possible and, in any event, within 7 business days following the day we received your returned Product.
Once your sample is received by our testing laboratory no refund will be possible. However, if you are unhappy with your purchase for any reason please contact Claro Labs at email@example.com. Claro Labs values your support and feedback on how to better serve our customers.
